These Terms of Service ("Terms") govern your use of Hey Toolie ("the service", "we", "us"). By using Hey Toolie you agree to these Terms. If you do not agree, please do not use the service.

1. What Hey Toolie is

Hey Toolie is an AI-powered tool that helps you build, plan, and think through ideas. It uses artificial intelligence to generate content based on your inputs. The service is provided free of charge for personal and small-business use, subject to daily usage limits.

2. Your account

You must be at least 13 years old to use Hey Toolie.
You are responsible for keeping your account credentials secure.
You may not share your account with others or use someone else's account.
You may delete your account at any time. We will delete your data promptly upon request.

3. Acceptable use

You agree not to use Hey Toolie to:

Generate or distribute illegal, harmful, abusive, defamatory, or fraudulent content
Violate any applicable law or regulation
Attempt to reverse-engineer, scrape, or bypass the service's security or rate limits
Use the service for bulk generation, spam, or automated abuse
Enter sensitive personal information about yourself or others (passwords, ID numbers, financial details, medical records) into AI prompts
Harass, threaten, or harm other users

We reserve the right to suspend or terminate accounts that violate these terms without notice.

4. AI-generated content

Important: The content generated by Hey Toolie is produced by an AI and may be inaccurate, incomplete, or unsuitable for your specific situation. It is not professional legal, financial, medical, or business advice. Always verify important information independently before acting on it.

We make no warranties about the accuracy, completeness, or fitness for purpose of AI-generated content. You use it at your own risk.

5. Ownership of your content

You own the ideas, descriptions, and inputs you provide to Hey Toolie. The AI-generated output produced from your inputs is also yours to use freely — commercially or otherwise.

By using the service, you grant us a limited licence to store and process your content solely to provide the service to you. We do not claim ownership of your content and do not use it to train AI models.

6. Sharing and shared tools

When you share a tool via a share link, you make that tool's content accessible to anyone with the link. You are responsible for ensuring you have the right to share the content you publish. Do not share tools containing confidential, sensitive, or third-party-owned information without appropriate permission.

Shared tools remain your property. We may remove shared tools that violate these Terms.

7. Service availability and usage limits

Hey Toolie is provided "as is". We do not guarantee uninterrupted availability. We may:

Impose daily usage limits (generations and chat turns) to ensure fair access for all users
Modify, suspend, or discontinue any part of the service at any time
Update these Terms — continued use after changes means you accept the updated Terms

Signed-in users receive a higher daily limit than anonymous users. Limits are subject to change.

8. Third-party services

Hey Toolie relies on third-party services including Google Gemini (AI generation), Supabase (data storage), and Google OAuth (sign-in). Your use of these services is also subject to their own terms and privacy policies. We are not responsible for the acts or omissions of third-party providers.

9. Disclaimer of warranties

Hey Toolie is provided "as is" and "as available" without any warranty of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the service will be error-free, uninterrupted, or that AI-generated content will be accurate or reliable.

10. Limitation of liability

To the fullest extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use Hey Toolie, including but not limited to loss of profits, data, or business opportunities, even if we have been advised of the possibility of such damages.

Our total liability to you for any claim arising from use of the service shall not exceed the amount you paid us in the 12 months preceding the claim (which, for free users, is zero).

11. Governing law

These Terms are governed by the laws of South Africa. Any disputes will be resolved in the courts of South Africa. If you access the service from another jurisdiction, you are responsible for compliance with local laws.
